Informed Consent

When you collect personal data, do you inform or explain to the person the purposes for which it will be collected, used or disclosed and obtain his/her consent? This could be in writing (email, letter, standard form, online terms, policy) or otherwise.

If you intend to collect personal data without consent, you should check the Second Schedule and other sections of the PDPA to ascertain whether you may collect personal data without consent.

IF NO:

You should explain the purpose for collecting, using, storing or using personal data, and obtain consent. You may wish to use the following sample clauses or wording in your consent form, website, privacy policy, etc.

 

Sample Purpose Clause

You agree that we [or organisation's name] may collect, use and disclose your personal data you provided to us for any of the following purposes, in accordance with the Personal Data Protection Act 2012:

  • to provide you with any of our products or services;

  • to bill for any of our products or services provided to you and to request for, or enforce, payment of the same;

  • to arrange for third parties to help us provide our products or services to you, including (among other things) storage, tracking or delivery of our products or services;

  • to better serve you by matching your preferences or needs with relevant products or services;

  • to communicate with you regarding our website, products, services, programs or events;

  • to provide you with information on select third parties’ websites, products, services, programs or events which we think may be of interest to you;

  • to respond to your queries or requests;

  • to manage our business operations;

  • to improve our business, website, products, services, programs or events;

  • to investigate any wrongdoing in relation to our business, website, programs or events;

  • for legal purposes, including obtaining legal advice, managing disputes and risks, complying with any laws;

  • any other purposes relating to the above purposes.

Sample Marketing Materials Consent Clause

You agree that we [or organisation's name] may collect, use and disclose your personal data you provided to us for providing the following types of marketing communications, in accordance with the Personal Data Protection Act 2012.
